  1. EFFECTIVE DATE AND GENERAL

    This Privacy Policy (hereinafter the “Policy”) takes effect on September 22, 2023.

    Agri-Marché Inc. and its subsidiaries (hereinafter “Agri-Marché” or “we”) are committed to protecting the confidentiality and security of all your personal information, as defined in Section 2, collected as a result of our relationship with you. 

    This Policy explains the following, among other things :

    • The types of personal information we collect
    • When we collect that information
    • How we use and share the personal information we collect
    • The steps we take to ensure that your personal information is properly protected throughout its life cycle
    • How you can contact us if you have questions about your personal information  


    We have adopted this Policy for the purpose of compliance with the applicable laws of Quebec and Canada respecting the protection of privacy and personal information. The Policy applies to any personal information about you that we collect or receive from you or any other source, via our website or by any means of communication.  

    The Policy is up to date, and we may modify it at any time.

    Our site may contain links to other websites owned and operated by third parties. The Policy does not apply to such websites or the services to which they refer, and we assume no responsibility for their content.

  2. DEFINITION OF PERSONAL INFORMATION

    The Policy applies to personal information as defined in the Act respecting the protection of personal information in the private sector, i.e., any information that relates to a natural person and directly or indirectly allows that person to be identified.

    For example, for the purposes of applying the Policy, this may include your first and last name, your postal address or postal code, your personal telephone number and email address, your date of birth, your gender, your language, your banking information, and your education and work experience. 

    Information regarding the exercise of a function within a company, such as an individual’s name, title, position, work postal address, work email address and work telephone number, constitutes personal information of a public nature and is therefore not subject to the protection rules in this Policy.

  3. CONSENT

    We are committed to obtaining consent before collecting an individual’s personal information. Consent may be express where required by law or implied in other cases and may be provided directly by the individual or by his or her authorized representative. 

    By browsing our website or using our systems or services, you acknowledge that you have read and understood this Policy and consent to the handling of your personal information in accordance with it.

    We do not collect personal information from anyone under the age of 14. If a parent or guardian becomes aware that his or her child or a child under his or her guardianship has provided us with personal information without his or her consent, the parent or guardian should contact us using the contact information provided in the “Contact us” section on the last page of the Policy to have such information destroyed.

  4. COLLECTION OF PERSONAL INFORMATION

    We collect personal information directly from you in the following cases:
    • You open a customer account. ;
    • You apply for credit. ;
    • You purchase a product or request information about your purchases. ;
    • You contact us or send us your questions, comments, suggestions or complaints. ;  
    • You apply for a job. ;
    • You participate in a survey in which you have agreed to participate. ;
    • You create or access an account on our site.


    We may also collect, share and otherwise use information about Agri-Marché that you voluntarily share on social media sites such as Facebook and X (formerly Twitter). Agri- Marché’s use of such information will not be subject to any restrictions, limitations or compensation of any kind.

    Telephone calls we receive may be recorded and monitored for quality control purposes. In addition, closed-circuit security cameras may be used inside and outside our offices to ensure the safety of customers, employees and third parties.

  5. USE AND RETENTION OF PERSONAL INFORMATION

    We use your personal information in our operations to provide you with our products and services and support our business activities. Specifically, we use your personal information for the following purposes:

    • Process your purchases and related transactions ;
    • Provide you with customer service and respond to your inquiries ;
    • Develop and improve our products and services ;
    • Manage and improve the customer experience ;
    • Protect our rights, our property and the safety of our employees and customers ;
    • Prevent and detect fraud ;

    • Halt the sharing of personal information about you, or deindex any hypertext link to personal information about you ;
    • Request deletion of your personal information when it is out of date or we have no valid reason to continue to retain it 


    You may make any such requests using the contact information provided in the “Contact us” section on the last page of the Policy.

    However, we reserve the right to retain a copy of your personal information and use it as necessary to comply with our statutory obligations, resolve disputes and enforce our agreements.

  6. DISCLOSURE OF PERSONAL INFORMATION

    We do not disclose your personal information to anyone without your consent. Notwithstanding the above, we may share your personal information in the following cases: :

    • If disclosure is required by law ;
    • If disclosure helps us protect our rights, if we face a risk or in a situation where litigation is anticipated, or if the safety of our property, employees and customers is compromised
    • If disclosure is necessary for the investigation of illegal or suspected illegal activity or in response to a request from a law enforcement authority
    • To entrust a mandate or enter into a contract
    • For the purposes of a business transaction, subject to specific statutory measures


    Should such a situation arise, you will be informed of any such disclosure.

  7. MANDATARIES AND THIRD PARTIES

    We may offer certain products and services that will be provided by mandataries and third parties. For our operations, personal information may need to be transferred to those third parties so that they can properly fulfil their obligations, particularly for external processing purposes, for storage on cloud servers or as part of a collaboration with affiliated companies.

  8. PROTECTION MEASURES

    We have implemented physical, organizational, contractual and technological security measures to protect your personal information and reduce the risk of loss or theft, unauthorized access, disclosure, copying, misuse or modification of your personal information.

    We periodically update and review such security measures. 

  9. LIMITATION OF LIABILITY

    Notwithstanding these security measures and our efforts, you acknowledge that no system or network can be completely secure and that there are inherent risks in disclosing personal information on web browsers and electronic devices. We are not responsible for any unauthorized disclosure of personal information that occurs through no fault of our own.
